As far as the law is concerned in the UK, a 49cc moped is the same as a 50cc moped and there is no legal difference. CC is the measurement of enine capacity (in cubic centimetres) and is one of the ways used for measuring the power of an engine.
In the UK, the law specifies that a ‘moped’ much have “an engine capacity no greater than 50 cc”. Other countries define this as “less than 50cc” which means the manufacturers ensure that the engine has a 49 cc capacity to comply. The reason for the rules are to restrict speed and power so that younger drivers are allaowed to use them on the road. In the UK, this means that mopeds must be limited to do no more than 50 kmh (about 31 mph). Young drivers (ie 16 + years) are also required to hold a provisional driving licence and have passed Compulsory Basic Training (CBT).
